Terms of Service

1. Acceptance of terms
By creating an account or using Vufolio ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Vufolio, Inc.
2. Eligibility
You must be at least 13 years old to use Vufolio. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. Accounts may not be created on behalf of someone else without their express permission.
3. Your account
You are responsible for maintaining the security of your account credentials. Notify us immediately at support@vufolio.com if you suspect unauthorised access. We are not liable for any loss resulting from your failure to protect your credentials.
4. User content
You retain ownership of the photos, videos, and text you post ("Content"). By posting Content you grant Vufolio a worldwide, non-exclusive, royalty-free licence to store, display, and distribute your Content solely to operate and improve the Service. You represent that you own or have the necessary rights to the Content you post and that it does not infringe any third-party rights.
5. Prohibited conduct
You agree not to: post content that is illegal, defamatory, harassing, or harmful; impersonate any person or entity; spam, scrape, or automate interactions with the Service; attempt to gain unauthorised access to any part of the Service; or use the Service in any way that violates applicable law.
6. Content removal
We reserve the right to remove any Content or suspend any account that violates these Terms or our Community Guidelines, at our sole discretion and without prior notice. You may appeal a removal decision by contacting our support team.
7. Intellectual property
The Vufolio name, logo, and software are owned by Vufolio, Inc. and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks or proprietary materials.
8. Disclaimers
The Service is provided "as is" without warranty of any kind. We do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
9. Limitation of liability
To the maximum extent permitted by law, Vufolio's total liability to you for any claim arising from these Terms or your use of the Service will not exceed the greater of the amount you paid us in the past twelve months or USD $100.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law provisions. Any disputes will be resolved exclusively in the state or federal courts located in Delaware.
